Terms and Conditions for Image Usage

Blanket annual image bank subscriptions

USER REGISTRATION AGREEMENT
Register for an East Kootenay Image Bank License by sending an email to ferniesteve@gmail.com with “EKIB License Request” in the subject line. I will confirm your license as soon as payment is received. The full annual blanket license subscription giving you access to all images in all categories of the East Kootenay Image Bank is available for $350.00 CDN. If you need images but do not need access to the entire image bank you can ask for limited access to single categories(for example wildlife only) at a reduced rate of $100.00 per category. As a licensed user you can digitally download full-res images from my Shutterfly gallery for $1.99 each for commercial use. By registering for this image bank you acknowledge that you agree to be bound by our terms of use policy. If you have not read this policy please do not proceed with your registration at this time.

You will be able to use the images in the East Kootenay Image Bank for all your photo needs except those defined in the terms and conditions. See the terms and conditions for details.

License Terms and Conditions - Rights Managed and Royalty Free Images
This image bank has been designed to provide Royalty Free images specific to the East Kootenay region of BC, in particular the Elk Valley in the Canadian Rockies for advertising and editorial use. Royalty Free images or content is licensed for non-exclusive use of an image for an annual flat fee(annual blanket license).

The following terms and conditions apply to both Rights Managed and Royalty Free images created by Steve Short. All licenses granted by Steve Short must first be agreed upon before purchase with the following agreement.

All images are copyrighted and cannot be used without a usage license, payment, and agreement of usage terms. Image, image rights, and copyright, remain sole and exclusive property of the photographer. When purchasing an image license, you are purchasing a license to use the image for a specific period of time.

Permitted Uses - Rights Managed and Royalty Free Images
1. The license is Non-exclusive and is available for others to purchase. If you require exclusive use of any stock image, you must purchase it under different license terms, so please email me ferniesteve@gmail.com with your requirements. Once an exclusive license is purchased, we will remove it from our library.
2. The image or images may be installed and used on only one computer at a time. You may create one (1) copy of the image or images solely for back-up purposes, and you must store a copy of all licensing documents with the image or images on your backup.

Un-permitted Uses - Rights Managed and Royalty Free Images
1. The image or images are Non-transferable, the license is valid for the purchaser only. The image or images cannot be sold, resold, transferred, gifted, rented, sub-licensed, assigned, loaned, or distributed to anyone else.
2. The image or images cannot be used in any kind of product that allows the image to be copied, re-used, re-distributed, or extracted, such as a web template or electronic greeting card.
3. The image or images cannot be used or displayed in any content that features the model, person, or people in a manner that would lead a reasonable person to think that the person, people, or subjects endorses any product, service, business, association, cause, or other endeavour.
4. The image or images cannot be used or displayed in any content that features the model, person, people, or subject in a manner that depicts such person or subject in a potentially sensitive subject matter, including, but not limited to political issues, rights, animal right issues, social issues, mental and physical health issues, implied sexual preferences, implied sexual activities, crime, substance abuse, physical or mental abuse, or any subject matter that would be offensive, unflattering, or embarrassing to the person, people, or subject in the image.
5. The image or images cannot be used or displayed in any way that shows, displays, or depicts business, agriculture, livestock, or wild animals, East Kootenay life, in a negative or offensive way.
6. The image or images cannot be used or displayed in any manner that depicts the person, people, subject, or property in an obscene, pornographic, immoral, infringing, or damaging manner.
7. The image metadata, including copyright, and creators information cannot be removed from any image.
8. The image or images cannot be used for editorial use without including a copyright similar to ©Steve Short or www.rockiesimages.com

Royalty Free Web and Print License Terms and Conditions
Upon full payment of a license fee, Steve Short grants a non-exclusive, non-transferable worldwide license to use the selected image or images for the Permitted Uses (see below). All other image rights and copyright, remain sole and exclusive property of the creator, photographer, or artist.

Permitted Uses - Royalty Free Web and Print License under blanket annual subscription.
1. The image or images can be reproduced up to 250,000 times anywhere in the world. You may also use the image or images as long as you wish, as long as you are a paid subscriber and do not exceed 250,000 reproductions. Please email us if this reproduction limit does not meet your usage needs and we can create an extended reproduction limit at a discounted price.
2. The image or images may be used in advertising and promotional projects, including presentations, printed materials, posters and prints (not for resale), product packaging, commercials, catalogues, brochures, promotional greeting cards, promotional postcards, annual reports, film and video presentations.
3. The image or images may be used in entertainment applications or publications including books, book covers, magazines, editorials, newspapers, newsletters, video presentations, broadcast presentations, and theatrical presentations.
4. Images may be used on the web, but these images can only be used on one domain (i.e. www.yourdomainname.com); the images can be used on as many web pages within the domain as you desire. The image or images may also be altered for the Web if needed, but they cannot be included in any design that is resold.

Image Prints Terms and Conditions
Image prints are also available and can be ordered directly from our Shutterfly site. Prints cannot be reproduced, copied, or resold and are available for display only.
